>> that was kind of my understanding, is our conditional use is conditioned on the formation and approval of the sud, but that's understood we can take that action and encourage the board of supervisors to establish the sud that would allow this to happen. and i remember that happening on quite a few projects. i can't bring them up line and verse, it's happened. perhaps zoning administrator sanchez can -- >> yes, recently in december with the adoption of the western soma plan, the item immediately after that was an approval of a project under the western soma plan. the western soma plan still hasn't been to the land use committee, but that would probably not become adopted and effective until april or may. and, so, the approval that this commission gave was contingent upon the successful adoption of those rezoning efforts. so, this is something that this commission has done numerous times. there are many, many examples of this. >> thank you. and finally, as to the approvals themselves that are before us, i think they seem to be fairly formulated for the project owner who wou

. approval of the special use district violates the conformity requirement of state law. the proposal to adopt the so-called special use district, the one parcel of land is for the express purpose which is to grant the owner an exemption from numerous zoning rules is in essence a variance. as such, the city must comply with the procedures and make the substantive findings required by state and city law for approving a variance, which this proposal fails to do. the pagoda theater site is obviously much better than the columbus avenue extraction. we have worked and supported. our neighborhood merchants and neighbors not disrupting the business community for over a year or two. we also have a strong feeling that the pagoda site's $9 million expenditure to extract tbms which have salvage value at most 4.4 to $6 million is illogical. by not even extracting the machines at the pagoda, by varying the machines as has been done in new york city, in brisbane, australia, in the tunnel in the english channel, where machines are either lowered below tunnels or shifted to the side or [speaker not u

action of the board of supervisors once that special use district goes into law, we'll be able to move forward with the demolition of the building starting within the next couple of months so that we can keep our original timeline, which you'll recall that was to have the shaft built in time for the tunnel boring machines which are set to arrive about 12 to 15 months from now in north beach. so, that i think summarizes what we have before you. i just want to thank the many staff and the mayor and the board president for their work to get this done, and happy to take questions either now or after public comment. >> we can certainly ask members of the public to come forward at this point. do we have some names? >> yes, for item 11 greg gi ber, howard wong [speaker not understood]. those are the first three. >> good afternoon, sir. >>> good afternoon. thank you for allowing me to speak here. just now and again at the january public meeting on north beach, director reiskin assured us that this boring site, this would only be for the removal of the tunnel boring machines. with that restrict

conditional use authorization and staff recommends that you recommend to the board of supervisors to approve the sud and height reclassification. * this concludes my presentation. i'm available for any questions you may have. thank you. >> thank you. >> good afternoon, commissioners. i'm brett gladstone, partner in the san francisco firm of hanson bridget. i'm here today speaking on behalf of the project sponsor royal campus. i'd like to introduce some members -- is it 3 minutes? some members of the team and i'd like them to stand up as i introduce them. first of all, my client [speaker not understood] campos. and my co-counsel, jonathan rodriguez. jonathan will be available for questions on construction issues and lease with the city if you have any. i'll be talking about the planning issues. i'd also like to introduce consultant martin kirkwood and consultant jorge mandragon. first, i'd like to thank the city, particularly scott sanchez and kevin guy, for their hard work on this in the recent weeks, and david chiu, supervisor chiu and his aide, justin true as well. this is the t

use and rezonings. that didn't prove to be economically feasible. silver leathers came before the commission. however, this is the first one by mr. campos, my client, and i was at the commission in 2009 when you approved this 6 to 1 with dozens of community members supporting it in 2009. unfortunately, as you know in that period, the econ kind of fell apart and financing and so did equity. and when you approved, it was not a good time to get financing and start construction. * economy now the aloe am -- economy has come back, lending is available. the client is ready to go forward and start with all the final permitting when the city claim to the client a few months ago and asked that his construction be delayed by reason of using the site for up to two years for removing the boring equipment. and since then my client has agreed to delay his construction. and there are some risks. however, it seems like it's what's best for the city and the neighborhood, and was willing to come back before you and is today on essentially the same project. but instead of a demolition -- excus

into a lease and we would immediately start constructing the shaft. in order for us to have the shaft built in time for the machines to get there, we need to start that. our original plan was to start that work in january of this year. so, we're already behind on that. so, before we start impacting the critical path, that is not a decision that would be made in a year. it's a decision we'd be making now to move forward with the demolition and the excavation to build the shaft. >> director big nan. >> if we could discuss the funding. i don't remember if it was in open session or closed session -- was it in closed session? can we discuss that very briefly? i know that the number you gave us versus the number that seems to be perceived by the public were different. so, if we could just briefly go through the funding and where it is going that would be great. >> i think the confusion on the total amount was just a mad matter of ating the components of the 1.15 -- and .15. it is .15 million and [speaker not understood]. * 9.15 again, those are both not to exceed numbers. so, that's kind of a wo
